Hard Count Terms & Conditions
Effective October 19, 2026 · Last updated October 19, 2026
1. Agreement and service
These Terms & Conditions govern Hard Count, provided by Vanbus LLC (“we,” “us,” or “our”). They cover the app and related services that link to these terms. By using the service, you agree to these terms. If you do not agree, stop using the service. Questions can be sent to vanbusllc@gmail.com.
Hard Count lets you make football decisions in simulated pro and college game scenarios, review your results, and use supported standings and social features. Features may vary with your app version, connectivity, and account status.
2. Children, parents, and eligibility
Hard Count is intended to include children under 13 as well as older players. If you are below the age at which you can enter a binding agreement where you live, your parent or legal guardian must review and agree to these terms for your use and supervise that use.
By allowing a child to use Hard Count, a parent or legal guardian agrees to these terms for the child's use. Any parental consent required by applicable privacy law must be obtained before collecting, using, or sharing the child's personal information. See the children's privacy section.
3. Accounts and social features
Online account features use Sign in with Apple. You are responsible for protecting access to your Apple account and device, choosing an appropriate display name, and using your own account. Do not impersonate others or share account credentials. Contact us if you suspect unauthorized access.
Friend codes allow users to connect and compare gameplay results. Share codes carefully. Do not put contact details or other sensitive information in display names. You can remove friends using the app's controls. Report abusive behavior or inappropriate names to vanbusllc@gmail.com.
4. License and intellectual property
Subject to these terms and applicable App Store usage rules, we grant you a limited, personal, non-exclusive, non-transferable license to use Hard Count on devices you own or control. Vanbus and its licensors retain their rights in the app, software, designs, and content. Third-party rights and applicable open-source licenses remain with their respective owners.
You may use the app's provided sharing features for personal sharing. You may not sell, redistribute, commercially exploit, or copy the app or its content without permission, except as expressly allowed by law or an applicable license. You may not reverse engineer or bypass technical protections except where applicable law permits that activity.
5. Acceptable use and fair play
You must not:
- Use the service for unlawful activity, harassment, impersonation, threats, or infringement of others' rights.
- Manipulate scores or standings, submit fabricated runs, exploit bugs, or automate gameplay or requests to gain an unfair advantage.
- Attempt unauthorized access, collect other users' information without permission, distribute malicious code, or disrupt the service.
- Use offensive names or disclose someone else's private information.
We may investigate suspected abuse and correct or remove invalid results, restrict social features, or suspend access where reasonably necessary to protect users, fair play, or the service, subject to applicable law.
6. Simulations, scores, and affiliation
Gameplay, win probabilities, scores, and comparisons are simulations and estimates. They are not predictions, guarantees of real-world results, betting advice, or professional coaching advice. Data and scenario descriptions may contain errors or be updated. Changes to the engine, scoring rules, eligibility rules, or available content can affect results and standings. Standings and in-game scores have no cash value.
Hard Count is not affiliated with or endorsed by the NFL, the NCAA, any conference, team, or school. References to games, cities, schools, or teams are for identification and context; third-party names and marks remain the property of their owners.
7. Privacy and your information
The Hard Count Privacy Policy explains account information, gameplay records, friends, notifications, and your choices. You retain rights in personal information and any content you supply. You permit us to process and display that information only as needed to provide the features you use and as allowed by the policy and applicable law.
Suggestions and feedback may be used to improve the service without an obligation to compensate you. Do not send material you do not have the right to share.
8. Apple and third-party services
Apple's terms apply to your Apple account and App Store use. Where Apple's standard Licensed Application End User License Agreement applies to your download, it governs the app license alongside these service terms; mandatory platform terms and consumer rights take precedence over conflicting provisions.
Vanbus provides Hard Count and its support; these terms do not make Apple responsible for our service. Sign-in, notifications, hosting, and other third-party services depend on their providers and may be unavailable. Links to third-party services are subject to those providers' terms and privacy policies.
9. Changes, availability, and termination
We may update, change, or discontinue features or content, and service interruptions can occur. We do not promise continuous availability, a particular content-release schedule, permanent storage of gameplay history, or compatibility with every device or OS version.
You can stop using Hard Count at any time. To permanently delete your account and associated game history, friends, and alerts, open Profile → Delete account → Delete permanently. Successful deletion clears local account history and session data on that device; team and color preferences remain available without an account. Follow the separate post-deletion instructions to disconnect Sign in with Apple. Signing out or uninstalling the app alone does not delete your server-side account. For deletion assistance or other data requests, contact vanbusllc@gmail.com. We may suspend or terminate access for serious or repeated violations or where required by law. Provisions that by their nature should survive termination continue to apply.
10. Disclaimers and responsibility
To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of uninterrupted operation, complete accuracy, or fitness for a particular purpose. You are responsible for your own device and connectivity and for keeping copies of information you need.
To the extent permitted by law, Vanbus is not responsible for indirect or consequential losses resulting from use of, or inability to use, the service. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or any mandatory consumer protection. Statutory rights and remedies remain available to you.
11. Governing law and disputes
These terms are governed by the laws of New York, United States, without overriding mandatory protections or rights available under the law where you live. Please contact us first about a dispute so we can try to resolve it. Nothing here requires arbitration, waives a right to bring a claim, or prevents you from using a court or regulator available under applicable law.
12. Updates and contact
We may revise these terms. We will update the date and give notice of material changes as required by law. Continued use after a properly notified change becomes effective constitutes acceptance to the extent permitted by law. Where further agreement or consent is required, we will obtain it.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of it.
